Company Sues CBN For ENaira Trademark Infringement.

The name of the soon to be launched central bank of Nigeria’s digital currency, eNaira is under contest by a company claiming registered trademark for the name of the digital currency.

A cease and desist letter was served to the Central Bank of Nigeria (CBN) concerning the use of the name “eNaira.”

The letter made available to news media, titled: “Infringement of Trademark & Violation of Corporate Name cease and desist Notification to the Central Bank of Nigeria.” was signed by Olakule Agbebi Esq for Olakule Agbebi & Co .

From the notice order, Olakule Agbesi who is the company’s solicitor stated that his client, “ENaira payment Solutions Limited (RC 508500) was incorporated and registered with the Cooperate Affairs Commission on the 7th day of April, 2004, over 17 years ago class 36 and 42 classified entities.

Citing threat to business and willful infringement on the trademark as the reason for suing CBN, the letter reads;

“our client has approached the Federal High Court in Suit No: FHC/AB/CS/113/2021 between ENAIRA PAYMENT SOLUTIONS LIMITED vs CENTRAL BANK OF NIGERIA to seek a restraining order including an order to restrain CBN from proceeding in the launch on 1st October 2021,  the Notice stated.

The Notice added, “In the interim, the CBN is hereby warned to cease and desist from using or purporting to use the name eNaira for its product or in any way.”
